Talins.top DMCA Policy

1. General Provisions

1.1. This DMCA Policy (hereinafter referred to as the "Policy") governs the procedure for handling copyright infringement notices on the Talins.top platform (hereinafter referred to as "Talins", the "Platform", or "We").

1.2. Talins respects the intellectual property rights of copyright holders and strives to respond to valid notices of alleged infringements.

1.3. This Policy has been developed with consideration of the Digital Millennium Copyright Act (DMCA), applicable international legislation, legislation of the Russian Federation, and generally accepted principles of intellectual property protection.

1.4. Talins is a user platform and may contain user-generated content, including images, texts, avatars, messages, listings, descriptions, reviews, uploaded files, and other materials published by users.

1.5. Talins does not conduct preliminary legal review of all user-generated content.

2. Platform Status

2.1. Talins is a platform providing communication infrastructure, a listing publication system, integrated chats, a Middleman Service, and user interaction tools.

2.2. The User is solely responsible for the content they publish.

2.3. Talins does not claim ownership rights over user-generated content.

2.4. Talins reserves the right to remove content, restrict access, block users, and suspend accounts where there are indications of intellectual property rights violations.

3. Copyright Infringement Notice

3.1. If You believe that content posted on Talins infringes Your copyright or intellectual property rights, You may submit a notice to us.

3.2. The notice must contain:

  • full name of the copyright holder or authorized representative
  • contact information
  • email address for communication
  • description of the copyrighted work
  • link to the original material (if applicable)
  • URL or exact location of the disputed content on Talins
  • description of the alleged infringement
  • a statement of good faith belief that the use of the material is unauthorized by the copyright holder
  • a statement confirming the accuracy of the information
  • electronic or physical signature of the claimant.

3.3. Incomplete or inaccurate notices may be rejected.

4. Where to Send DMCA Notices

5.1. Upon receipt of a notice, Talins may request additional information, temporarily restrict access to the content, remove content, notify the user, or conduct an internal review.

5.2. Talins independently determines the necessary response measures.

5.3. Talins does not guarantee immediate removal of content.

5.4. In cases of obvious infringement, Talins may remove content without prior notice to the user.

6. Counter-Notice

6.1. If a User believes that content was removed in error, they may submit a counter-notice.

6.2. The counter-notice must contain:

  • User identification data
  • contact information
  • description of the removed content
  • explanation of the reasons for disagreement
  • a statement of good faith belief that the removal was erroneous
  • consent to dispute resolution in the applicable jurisdiction
  • electronic or physical signature.

6.3. Talins may reject the counter-notice, request additional information, restore content, or maintain restrictions in force.

7. Repeat Infringements

7.1. Talins may restrict access for users who repeatedly infringe intellectual property rights.

7.2. In cases of repeated infringement, Talins may delete accounts, restrict functions, block IP addresses, and permanently suspend accounts.

7.3. The decision on whether an infringement is considered repeated is made independently by Talins.

8. User Content

8.1. The User guarantees that they possess the necessary rights to the content they publish.

8.2. The User agrees not to publish stolen materials, unlicensed content, images infringing third-party rights, third-party trademarks without permission, or pirated materials.

8.3. The User is solely responsible for intellectual property violations.

9. Limitation of Liability

9.1. Talins operates as a user platform and does not perform continuous legal monitoring of all user-generated content.

9.2. Talins does not guarantee the absence of infringing content on the Platform.

9.3. Talins is not responsible for user-generated content, actions of users, copyright infringements committed by third parties, or losses associated with content posted by users.

9.4. Talins may rely on the good faith of information provided in DMCA notices.

10. False Notices

10.1. Submission of knowingly false DMCA notices is prohibited.

10.2. The User understands that abuse of the complaint system may result in removal of complaints, account restrictions, blocking, or other measures.

10.3. Talins may reject abusive or bad-faith complaints.

11. International Application

11.1. Talins is available to an international audience.

11.2. The User understands that intellectual property protection may be governed by the laws of different countries.

11.3. Talins may apply measures necessary to comply with international copyright protection requirements.

12. Changes to the Policy

12.1. Talins may amend this DMCA Policy at any time.

12.2. The new version becomes effective upon publication on the Platform.

12.3. Continued use of Talins constitutes the User's acceptance of the updated version.
