Talins.top User Agreement

1. General Provisions

1.1. This User Agreement (hereinafter referred to as the "Agreement") governs the relationship between the owner and administration of the Talins.top platform — Kirill Alekseevich Avsenin (alias: Fanatic), acting as an individual registered in the Russian Federation (hereinafter referred to as the "Administration", "Talins", "Platform", "We"), and any person using the talins.top website, its subdomains, mobile versions, applications, APIs, integrations, Discord/Telegram communities, services, and other related digital products (hereinafter referred to as the "Website" or "Platform").

1.2. Talins is a digital online platform for publishing listings, communication between users, organizing in-game transactions, using the Middleman Service, storing interaction history, and other functions related to in-game trading.

1.3. The Platform is not a party to user transactions and does not act as a seller, buyer, supplier of gaming items, or owner of users' digital assets unless otherwise expressly stated separately.

1.4. By using the Platform in any manner, including:

account registration
browsing pages
using chats
publishing listings
uploading content
interacting with the Middleman Service
participating in transactions
using Discord/Telegram integrations

the User confirms that:

they have read this Agreement
they understand its terms
they fully and unconditionally accept it.

1.5. If the User does not agree with any provision of the Agreement, they must immediately cease using the Platform.

1.6. Use of the Platform is permitted only for persons over the age of 13.

1.7. The User confirms that they are solely responsible for complying with the laws of their country and the rules of gaming platforms within which transactions are conducted.

2. Legal Status of the Platform

2.1. Talins is an independent user platform and is not affiliated with Roblox Corporation or any other gaming companies, publishers, rights holders, marketplaces, or game developers unless otherwise expressly stated.

2.2. All trademarks, logos, game titles, images, and other intellectual property objects belong to their respective owners.

2.3. Talins exclusively provides:

informational infrastructure
communication systems
listing publication systems
tools for user interaction
middleman services
reputation and review systems.

2.4. Talins does not guarantee:

successful completion of transactions
honesty of users
security of exchanges
authenticity of gaming items
compliance of transactions with the rules of specific games.

2.5. The User understands and agrees that all transactions are carried out voluntarily and at their own risk.

3. Account Registration

3.1. To access certain functions of the Platform, the User must create an account.

3.2. Upon registration, the User agrees:

to provide accurate information
not to impersonate another person
not to use another person's data
not to create accounts to circumvent restrictions
not to transfer account access to third parties.

3.3. The User is solely responsible for:

maintaining password confidentiality
account security
actions performed through their account.

3.4. The Administration has the right to restrict access, suspend an account, delete an account, or restrict certain functions without prior notice if there is suspicion of: fraud, scam activity, violation of rules, system abuse, circumvention of bans, use of bots, or threats to platform security.

3.5. The User does not acquire ownership rights to a Talins account.

4. Age Restrictions

4.1. Use of the Platform is permitted for persons over the age of 13.

4.2. The User confirms that they have reached the minimum age permitted by the laws of their country for using digital services.

4.3. If the laws of the User's country require parental or legal guardian consent, the User agrees to obtain such consent independently.

4.4. The Administration may restrict access to the Platform if doubts arise regarding the User's age.

5. Platform Usage Rules

5.1. The User agrees to use the Platform in good faith, reasonably, and exclusively for lawful purposes.

5.2. The User is prohibited from:

violating the law
using the Platform for fraud
publishing scam listings
deceiving users
using fake transaction evidence
impersonating Talins staff
using automated scripts, bots, or parsers
attempting unauthorized access or hacking
interfering with server operations
conducting DDoS attacks
distributing malicious software
publishing NSFW content
posting extremist, illegal, or discriminatory content
publishing materials that infringe copyright
selling prohibited digital goods
using the platform for money laundering
circumventing bans and restrictions
artificially inflating reviews or reputation.

5.3. The User agrees to comply with the rules of gaming platforms within which transactions take place.

5.4. Talins does not encourage or approve activities that violate the user agreements of gaming platforms.

5.5. The User bears sole responsibility for possible sanctions imposed by gaming platforms, including bans, restrictions, account deletions, and loss of gaming items.

6. Listings and User Advertisements

6.1. The Platform provides the ability to publish listings regarding in-game exchanges, sale of digital gaming items, searching for transactions, exchange of gaming currency, and gaming services.

6.2. The User agrees to publish only accurate information.

6.3. The Administration has the right to moderate, hide, delete listings, reject images, or restrict content visibility without providing reasons.

6.4. It is prohibited to post scam listings, fake offers, misleading information, prohibited content, sexually explicit materials, or malicious links.

6.5. The Administration does not guarantee successful transactions, profit generation, availability of buyers, or safety of counterparties.

7. Middleman Service

7.1. Talins may provide a middleman service ("Middleman Service" or "MM Service") to facilitate in-game transactions.

7.2. The Middleman Service is intended solely to assist users and is not a financial, banking, escrow, or licensed payment service.

7.3. Talins middlemen are representatives of the Platform only within the scope of the official Talins MM Service.

7.4. Partner, third-party, or unofficial middlemen are not representatives of Talins.

7.5. The User must independently verify that they are interacting with the official Middleman Service.

7.6. Talins has the right to reject MM requests, terminate transaction support, remove middlemen, and modify MM Service rules.

7.7. Despite the existence of the MM Service, the User understands and agrees that:

all transactions are conducted at their own risk
Talins does not guarantee absolute security
Talins does not provide financial guarantees
Talins does not compensate losses
Talins does not insure transactions.

7.8. Talins shall not be liable for actions of users, fraud by third parties, loss of gaming items, bans of gaming accounts, or actions of third-party MM services.

7.9. The User understands that the Middleman Service is an auxiliary tool and does not completely eliminate the risk of fraud.

8. Reputation, Reviews, and Vouch System

8.1. The Platform may provide reviews, ratings, a vouch system, a scam-report system, and trust indicators.

8.2. The Administration does not guarantee the accuracy of user reviews.

8.3. It is prohibited to purchase reviews, artificially boost reputation, publish false accusations, or engage in harassment campaigns.

8.4. The Administration may remove reviews and restrict reputation-related functions.

9. Messages, Chats, and Communications

9.1. The Platform may contain private messages, group chats, system notifications, files, and communication history.

9.2. The User understands that messages may be stored on Talins servers for purposes of security, moderation, investigation of violations, and platform operation.

9.3. It is prohibited to use communication functions for threats, blackmail, harassment, fraud, distribution of malicious links, spam, or illegal activities.

9.4. The Administration may conduct automated and manual moderation of messages.

9.5. The User agrees that system messages and platform events may be automatically recorded and displayed within the interface.

10. User Content

10.1. The User retains rights to their content.

10.2. By uploading content to the Platform, the User grants Talins a non-exclusive, worldwide, royalty-free license for storage, display, processing, adaptation, publication, and technical reproduction necessary for operation of the Platform.

10.3. The User guarantees that they possess rights to the content, do not infringe third-party rights, and that the content is lawful.

10.4. Talins may remove any content without prior notice.

11. Intellectual Property

11.1. All elements of the Talins platform, including design, interface, code, architecture, graphics, animations, logos, databases, UI components, and texts are objects of intellectual property.

11.2. It is prohibited to copy the platform, create derivative projects, decompile code, or use Talins elements without permission.

11.3. The User is granted a limited non-exclusive license to use the Platform exclusively for personal non-commercial purposes.

12. Intellectual Property and DMCA Policy

12.1. Talins respects the rights of copyright holders.

12.2. If a User believes their rights have been violated, they may submit a notice to: talinstm@gmail.com

12.3. The notice must contain a description of the copyrighted work, links to disputed material, contact information of the claimant, a statement of good faith, proof of rights, and the signature of the claimant.

12.4. The Administration has the right to remove disputed content, restrict access, and block infringers.

13. Personal Data and Privacy

13.1. Talins may collect and process email addresses, Discord IDs, browser data, cookies, IP addresses, message history, images, analytics, and interaction and transaction history.

13.2. Data processing is carried out for operation of the Platform, ensuring security, fraud prevention, service improvement, analytics, and performance of this Agreement.

13.3. By using the Platform, the User agrees to data processing in accordance with the Privacy Policy.

13.4. Talins strives to comply with GDPR, applicable EU legislation, legislation of the Russian Federation, and international data protection standards.

14. Cookies and Analytics

14.1. The Platform may use cookies, analytical systems, technical identifiers, session storage, and local storage.

14.2. The use of cookies is necessary for authorization, security, analytics, saving user settings, and interface functionality.

14.3. The User may restrict the use of cookies through browser settings.

15. Limitation of Liability

15.1. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

15.2. Talins does not guarantee uninterrupted operation, absence of errors, permanent availability, absolute security, preservation of data, or compatibility with user devices.

15.3. Talins shall not be liable for direct or indirect damages, loss of gaming items, loss of accounts, actions of third parties, user fraud, scam activity, loss of profits, bans of gaming accounts, decisions of gaming platforms, or user transactions.

15.4. Talins does not act as a guarantor of transactions.

15.5. The User independently evaluates the risks of any interactions.

15.6. Talins' maximum liability shall in any case be limited to the amount actually paid by the User to the Platform during the last 3 months of service use, or the equivalent of 10 USD if no payment was made.

15.7. Certain jurisdictions may not permit specific liability limitations, therefore certain provisions may not apply in full.

16. Prohibited Goods and Activities

16.1. The following are prohibited on the Platform: sale of real financial services; trade in illegal digital goods; distribution of malicious software; sale of stolen accounts; sale of personal data; sale of prohibited content; publication of fraudulent schemes.

16.2. The Administration may remove relevant content without notice.

17. Suspension and Termination of Access

17.1. Talins has the right to restrict access, delete accounts, remove content, restrict functions, or block IP addresses at any time in case of violation of the Agreement.

17.2. The User may cease using the Platform at any time.

17.3. Account deletion does not release the User from liability for previously committed violations.

18. Changes to the Platform and Agreement

18.1. Talins has the right to modify functionality, update the interface, introduce new restrictions, change rules, and discontinue certain services.

18.2. Talins may amend this Agreement at any time.

18.3. The new version enters into force from the moment of publication on the Platform.

18.4. Continued use of the Platform constitutes acceptance of the updated Agreement.

19. International Use

19.1. Talins is available to an international audience.

19.2. The User is solely responsible for compliance with the laws of their jurisdiction.

19.3. The User confirms that use of the Platform does not violate the laws of their country.

20. Dispute Resolution

20.1. The User agrees to first attempt to resolve disputes by contacting support.

20.3. This Agreement shall be governed by the laws of the Russian Federation to the extent that this does not contradict mandatory provisions of international and local laws applicable to the User.

20.4. If any provision of the Agreement is deemed invalid, the remaining provisions shall remain in force.
